I have debt collectors calling me and threatening me, can they do that ? And by law (Washington State) What can they do???
Answer:
The Fair Debt Collection Practices Act (FDCPA). This law requires many procedures to be followed by debt collection companies.
Think it's ftc.gov
Threatening calls aren't permitted. This site ought to give you enough infor to fight back.
Answer:
How are they threatening you? Bodily harm….lawsuits? If it's physical violence, get a tape recorder, then:
Next time they call, read the following statement:
Pursuant to [your state] state law, this is to inform you that this phone call is being recorded. If you don’t consent to being recorded, you need to terminate this call. Pursuant to [your state] state law, continuation of this phone call after officially being informed that it is being recorded implies consent to be recorded. This recording will be used to pursue Fair Debt Collection Practice Act violations in a court of law.
If the threat is for a lawsuit, then this is not explicitly illegal…it is illegal though for debt collectors to pretend to be attorneys when they are not….If you have any doubt ask for their license # in the state bar association.
Answer:
When you state they’re “threatening” you, what are they threatening? If they are threatening a law suit, then YES they can say that as long as they intend to follow through. If they’re threatening bodily harm, then NO they have the ability to not do that.
However, if the company takes you to court, gets a judgment, they will be able to garnish your wage, put liens on your property and levy your bank accounts.
I advocate making payment arrangements.
Good Luck.
