he gave no notice ,he just didnt turn up for work and never returned. He’s thinking of taking me to court.

Answer:
I would advocate you get advice from both of the organisations below. read the info on their websites to get some ideas of what you need to know then phone them both to discuss it with someone

Also, did you know that the law society run a lawyers for your business scheme for small businesses - http://www.lawsociety.org.uk/choosingand…

Answer:
You didn't say what he is thinking of taking you to court for, but I’m going to assume you fired him and that is why. That being stated if he gave no notice and just went on vacation for two weeks then he has NO legal ground to stand on. If he has any brains about him he’ll not take you to court, and if he does then you will be fine, there is nothing he can get you for. Assuming there isn't anything more to the story.

Answer:
Josiejum makes a good point. How do you know he went on holiday? Was it like, “Ummm, yeah, we haven't seen in you in a few days and we're gonna need you to come on in, so ummm, are you going to come in this day?” Employee replies, “I'm going to Disney World!” (very American dialogue but it works nonetheless), or was it a case of his leaving work, not coming in for two weeks and your assuming he was on the beach when he was ill? If that's the case, he might have a case. Of course, if you're in Britain (are you?), your laws will differ from those in the Says and you should consult your solicitor.

Update:

People really should not be able to give the thumbs-down without saying why. All I can state is that if the poster gave me that, it's rude.

Answer:
Its depends how long he has been working for you for. Less than two years you can sack him for scrathcing his @ss and court won't care. If its longer than that they will have a hearing . . . but stick to your guns, you are right to sack him! If he infor here’s correct he’ll just have to pay your court cost (And his own!) at the end of it! Tell him that and it is usually enough to cease the peasants from taking further action! Good Luck. Answer:
He can't take you to court as he left his job.. effectivly left without notice, only two weeks later wanted his job back.. There would of been no need to fire him because he ceased to work for you the moment he left.

I would of course take some legal advice, but really I doubt you’ve anything to worry about.. in fact he has to be pretty cheeky to even ask for his job back… or stupid!

Answer:
we have to be missing something, what’s he taking you to court for exactly. did you sack him for giving you no notice of his holiday because if you did you’re within your rights unless he had been working for more than 6 months and you didn’t allocate him any paid holiday, if so he has a case.

Answer:
Make sure you have the days

he missed documented. If he

took off, I'm sure there are other

areas, at work, he disrespects.

Have it written down as well.

From what you've explained,

he doesn't have a case.

Still, phone your local Legal

Aid Society, and ask. It's

free.

Answer:
Taking YOU to court?

You should have already fired him.

Let me guess, he's covered under an affirmative action category, and he's going to sue you for discrimination, despite that stunt he pulled.

Answer:
To cover your a**, make sure you document the days of work he missed and put that in his file. I would advocate sending him a letter at home that he has been terminated for absenteeism.

Answer:
why is he taking u to court, hes the one that broke a contract (assuming he had a work contract with you)

Answer:
I'm sorry, I don't understand the question.

Answer:
how do you no he was going on holiday

Answer:
